About our Services 1.1 **Overview** FeedbackStream provides businesses with the ability to: - Create an interview agent (an AI assistant) through their account; - Share a link to that agent with their customers; and - Collect and review audio or text-based responses from their customers. The AI assistant may allow customers to interact via voice input or audio messages, which are then processed to provide or record responses. 1.2 **Eligibility** There is no strict age requirement to use our Services. However, if you are a minor under applicable law, you should use our Services only with the involvement of a parent or guardian. By using our Services, you represent and warrant that all registration information you submit is accurate and truthful, and you have obtained all necessary consents to use these Services if you are under the age of majority in your jurisdiction. ## 2\. Account Registration and Responsibilities 2.1 **Account Creation** To access certain features of the Services, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account login credentials. 2.2 **Account Security** You agree to notify us immediately of any unauthorized use or suspected unauthorized use of your account or any other breach of security. User Content and Data 3.1 **User Content Definition** "User Content" includes any questions, prompts, or other text you submit to create your interview agent, and any responses—text, audio, or otherwise—provided by your customers through the interview agent link you share. 3.2 **Ownership and License** - **Your Content**: You retain all rights to the User Content you create or submit through the Services. By using our Services, you grant FeedbackStream a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Services. - **Customers’ Responses**: Responses provided by your customers—whether text or audio—belong to you and/or your customers, as applicable. It is your responsibility to handle, store, and process this data in compliance with all applicable privacy and data protection laws. 3.3 **Your Responsibilities** You are solely responsible for the User Content you create, share, or distribute, and for any actions that occur under your account. You agree not to: - Upload or transmit any content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable; - Impersonate any person or entity or misrepresent your affiliation with a person or entity; - Collect information in violation of any applicable law or regulation; - Upload or transmit any content that violates any third-party rights, including intellectual property or privacy rights. 3.4 **Data Protection and Privacy** Our [Privacy Policy](/content/privacy-policy/index.html) explains how we handle personal information and protect privacy. By using the Services, you agree to the terms of our Privacy Policy. ## 4\. Disclaimers and Limitation of Liability 6.1 **Disclaimer of Warranties** To the maximum extent permitted by applicable law, FeedbackStream provides the Services on an “as is” and “as available” basis and disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services are free of viruses or anything else harmful. 6.2 **Limitation of Liability** To the maximum extent permitted by law, FeedbackStream, its directors, employees, or agents shall not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, or for any loss of profits, revenues, or data arising out of or relating to your use of the Services. In no event shall FeedbackStream’s total liability for all claims related to the Services exceed the amount paid by you to FeedbackStream, if any, during the six (6) months preceding the date of the event giving rise to the claim. ## 7\.
